Terms and services
1. Ordering
- 1. The customer is not obliged to make the payment after placing an order.
- 2. The customer is not committed to anything and can stop paying at any time.
- 3. Orders will be delivered within the advertised indication on our website, unless there is not enough stock.
- 4. If the server turns out to be out of stock, it will be delivered within 7 working days else a refund will be processed.
- 5. Wasabi Hosting will do its utmost to ensure that there is always enough stock.
- 6. Pre-orders can't be refunded
2. Game server
- 1. If the consumer does not renew the server, Wasabi Hosting is authorized to shut down the server after it has been expired.
- 2. If the consumer does not renew the server, Wasabi Hosting is authorized to remove all data of this server, 3 days after the server is expired.
- 3. Support with regard to plugins/resources and code is not guaranteed.
- 4. Wasabi Hosting is not responsible in case of data loss. The customer is responsible for making backups.
3. VPS & Dedicated Servers
- 1. The customer is not allowed to host or run any websites/programs that are prohibited under law, such as performing DDoS attacks, hosting child porn content, and hosting copyrighted content.
- 2. The customer is not allowed to mine cryptocurrencies.
- 3. The customer is not allowed to configure a Seedbox.
- 4. With a virtual server, you share CPU performance with other customers; therefore, it's not allowed to use the CPU heavily for extended periods (Fair use).
- 5. It's not allowed to use your VPS or Dedicated server as a proxy or tunnel traffic to a server outside our network without explicit permissions. Manual approval is by creating a ticket.
- 6. Proxies & TOR Usage: The operation of proxies, including but not limited to TOR exit nodes or any services associated with the TOR network, is strictly prohibited on our infrastructure. Any efforts to deploy or use these services will lead to immediate enforcement actions, which may include suspension of the account. Clients must ensure their services do not involve proxy servers or TOR nodes in any form.
- 7. Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through our servers is prohibited. Likewise, the sending of UBE from another service provider advertising a website, email address, or utilizing any resource hosted on our servers, is prohibited. Our accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.
- 8. Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by our customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any Wasabi Hosting domain, or referencing any Wasabi Hosting account, is prohibited.
- 9. Wasabi Hosting blocks certain mail ports (TCP: 25, 465, 587) by default to prevent IP abuse and potential blacklisting.
- 10. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.
- 11. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org/rokso.
- 12. Wasabi Hosting is not responsible in case of data loss. The customer is responsible for making backups.
- 13. Wasabi Hosting will not provide support for third-party apps but sometimes can provide direction.
- 14. Wasabi Hosting is allowed to suspend the server if there is any kind of illegal activity on the server.
- 15. Wasabi Hosting is allowed to terminate the server if the customer's IP address used by the server is blacklisted on Spamhaus
4. Support
- 1. The customer can open a ticket in our Discord server or send us an email to [email protected], if he has any questions regarding his service.
- 2. The official (non-SLA) response time of Wasabi Hosting is 24 hours. But in practice this can be a lot faster.
- 3. Wasabi Hosting only offers support on the services provided by Wasabi Hosting.
- 4. Wasabi Hosting does not provide support for third-party software.
5. Refunds
- 1. By placing an order, the customer accepts that Wasabi Hosting does not accept any refund request that isn't covered by our refund policy.
- 2. On new orders ( none dedicated server ) we offer a 48 hour cooling off period (Refund window) in which you are entitled to a full refund. After this 48 hour window refunds can be denied.
3. All dedicated servers are treated as a business to business transaction and are none refundable due to there reseller nature. This in turn, means no refunds can be given. - 4. Downtime not caused by Wasabi Hosting such as a misconfiguration made by the customer does not count.
- 5. The customer needs to report a technical issue the the Wasabi Hosting support via the #create-support-ticket channel in our discord server and give Wasabi Hosting enough time to fix the issue.
- 6. A refund will be denied if the reason for the refund is: "I don't know how it works". The customer is responsible for installation and configuration of any programs or plugins in his server.
- 7. A refund will be processed within 7 business days.
- 8. Some countries have a legal period in which the customer can terminate their server without giving any reason. The customer then gets his money back. This is called Right of withdrawal (or herroepingsrecht). By placing an order with Wasabi Hosting, you agree to waive this right.
- 9. The customer may not refund the payment, through payment services such as PayPal by submitting a claim. They must always request a refund via the Wasabi Hosting support.
- 10. If the customer opens a claim with PayPal or opens a dispute at the credit card provider, Wasabi Hosting may immediately stop and delete the services of the customer without warning.
- 11. There will be no refund if illegal activity was found on your service.
6. Other obligations of Wasabi Hosting
- 1. Wasabi Hosting is not responsible for the content that the customer is hosting.
- 2. Wasabi Hosting will remove illegal content or other illegal applications/scripts that are not permitted by law.
- 3. Wasabi Hosting is not responsible for data-loss in any case. Customers are responsible for making backups next to the built-in in-house backup systems provided by Wasabi Hosting
7. Force of the majority
- 1. None of the parties is obliged to fulfill any obligation if it is prevented from doing so due to force majeure. Force majeure means in any case: war (danger), riots, strikes, war, fire, water damage, flooding, atmospheric conditions, prolonged power outages, adjustments or maintenance to the telecommunications network and / or electricity network of others, cable breaks, attacks on a network / server including DDoS and DoS, disruptions in the networks important for Wasabi Hosting, disruptions in communicative connections including telecommunication connections or prevention or refusal / prolonged absence of compliance by suppliers on whom Wasabi Hosting depends on the performance of its work is.
8. Changes in the terms and services
- 1. Wasabi Hosting is allowed to change the terms and services at any time.
- 2. Wasabi Hosting has to announce every change in the #announcements channel in it's Discord server.
