Terms of Service
1. Ordering
- The customer is not obliged to make the payment after placing an order.
- The customer is not committed to anything and can stop paying at any time.
- Orders will be delivered within the advertised indication on our website, unless there is not enough stock.
- If the server turns out to be out of stock, it will be delivered within 7 working days else a refund will be processed.
- Wasabi Hosting will do its utmost to ensure that there is always enough stock.
- Pre-orders can't be refunded.
2. Game Server
- If the consumer does not renew the server, Wasabi Hosting is authorized to shut down the server after it has been expired.
- If the consumer does not renew the server, Wasabi Hosting is authorized to remove all data of this server, 3 days after the server is expired.
- Support with regard to plugins/resources and code is not guaranteed.
- Wasabi Hosting is not responsible in case of data loss. The customer is responsible for making backups.
3. VPS & Dedicated Servers
- All customers must comply with our Acceptable Use Policy and Fair Use Policy, which detail prohibited activities, resource limits, and usage guidelines.
- Important: Wasabi Hosting blocks mail ports (TCP: 25, 465, 587) by default to prevent IP abuse and potential blacklisting. Opening these ports requires explicit approval via support ticket.
- Wasabi Hosting reserves the right to suspend services immediately if illegal activity is detected or if the server's IP address becomes blacklisted on Spamhaus or similar reputation services.
- Wasabi Hosting is not responsible for data loss. Customers are responsible for maintaining their own backups.
- Wasabi Hosting provides limited support for third-party applications and may only provide general direction.
- Service uptime guarantees and compensation for downtime are governed by our Service Level Agreement (SLA).
4. Support
- The customer can open a ticket in our Discord server or send us an email to hello@wasabihosting.com, if he has any questions regarding his service.
- The official (non-SLA) response time of Wasabi Hosting is 24 hours. But in practice this can be a lot faster.
- Wasabi Hosting only offers support on the services provided by Wasabi Hosting.
- Wasabi Hosting does not provide support for third-party software.
5. Refunds & Payments
- All services provided by Wasabi Hosting require advance payment. If payment is not received by the due date, your service will be suspended the following day. If payment is not made within 7 days of suspension, your server(s) will be automatically terminated, and your customer account will be closed. Wasabi Hosting is not responsible for recovering any data if payment is made after the termination date. To avoid service interruption or data loss, please ensure timely payment.
- Some countries have a legal period in which the customer can terminate their server without giving any reason. The customer then gets his money back. This is called the Right of Withdrawal (or herroepingsrecht). By placing an order with Wasabi Hosting, you agree to waive this right.
- If the customer opens a claim with PayPal or opens a dispute with their credit card provider, Wasabi Hosting may immediately stop and delete the services of the customer without warning.
- By placing an order, the customer acknowledges and agrees that Wasabi Hosting does not accept refund requests that fall outside the scope of our Refund Policy. Additionally, refunds are strictly denied if the request is in direct conflict with our Terms of Service.Example: If a customer requests the opening of mail ports that are explicitly blocked by our security policy, this constitutes a breach of our Terms. Refunds will not be issued in such cases, as the service was provided in accordance with our stated policies.
- For new orders (non-dedicated servers), we offer a 48-hour cooling-off period (Refund window) during which you are entitled to a full refund. After this 48-hour window, refund requests may be denied.
- All dedicated servers are treated as business-to-business transactions and are non-refundable due to their reseller nature. Therefore, no refunds can be given for dedicated servers.
- Downtime not caused by Wasabi Hosting, such as a misconfiguration made by the customer, does not qualify for a refund. For eligible downtime compensation, refer to our Service Level Agreement (SLA).
- The customer must report any technical issues to Wasabi Hosting support via the #get-help-here channel in our Discord server and give Wasabi Hosting enough time to fix the issue.
- A refund request will be denied if the reason for the refund is: "I don't know how it works." The customer is responsible for the installation and configuration of any programs or plugins on their server.
- A refund will be processed within 7 business days.
- There will be no refund if illegal activity is found on your service.
- The customer may not submit a claim through payment services such as PayPal. Refund requests must always be made through Wasabi Hosting support.
- Wasabi Hosting reserves the right to modify pricing with 60 days advance notice for existing customers.
- Price changes will be announced via Discord and email. Existing customers can maintain current pricing by prepaying for up to 12 months before the change takes effect.
- Promotional pricing is valid only for the initial term specified and will renew at regular rates unless otherwise stated.
6. Other Obligations of Wasabi Hosting
- Wasabi Hosting is not responsible for the content that the customer is hosting.
- Wasabi Hosting will remove illegal content or other illegal applications/scripts that are not permitted by law.
- Wasabi Hosting is not responsible for data-loss in any case. Customers are responsible for making backups next to the built-in in-house backup systems provided by Wasabi Hosting.
7. Force of the Majority
- None of the parties is obliged to fulfill any obligation if it is prevented from doing so due to force majeure. Force majeure means in any case: war (danger), riots, strikes, war, fire, water damage, flooding, atmospheric conditions, prolonged power outages, adjustments or maintenance to the telecommunications network and / or electricity network of others, cable breaks, attacks on a network / server including DDoS and DoS, disruptions in the networks important for Wasabi Hosting, disruptions in communicative connections including telecommunication connections or prevention or refusal / prolonged absence of compliance by suppliers on whom Wasabi Hosting depends on the performance of its work is.
8. Changes in the Terms and Services
- Wasabi Hosting is allowed to change the terms and services at any time.
- Wasabi Hosting has to announce every change in the #announcements channel in it's Discord server.
